Melissa B. Brisman is an expert in reproductive law. Melissa graduated Valedictorian from the Wharton School of Business at the University of Pennsylvania and graduated with honors from Harvard Law School. Melissa is uniquely qualified to help couples become parents. Melissa, though able to produce healthy viable eggs that could be fertilized by her husband’s sperm, was unable to carry a child herself. She, and her husband Dan, decided to elicit the aid of a gestational carrier – a carrier who is not biologically related to the child or children being carried. As a lawyer, Melissa knew that there were serious considerations when it came to selecting a carrier. She began her research, examining the laws in each state where a carrier might be obtained, with respect to the legality of surrogacy and the legal rights of the intended parents. There were many questions to consider such as who had control over the medical decisions once the carrier was pregnant, whose insurance policy would cover the pregnancy, and is it legal to pay the carrier for carrying the babies? Through her research, Melissa was able to resolve these questions and went on to be the happy mother of twin boys and later a girl, through the use of another gestational carrier. She is dedicated to helping other couples find the happiness she has experienced as a mother.
Melissa B. Brisman has gone on to become an accomplished leader in the field of reproductive law. She is the first attorney to obtain court orders directing that genetic parents be placed on the original birth certificates of their children born to gestational carriers in the State of Maine, in 1997, and in the State of New Jersey, in 2000. She argued and won landmark gestational carrier cases before the Supreme Court of Massachusetts, in 2001, and the State Supreme Court of New York, in 2004, setting legal precedents for birth orders in both states.
Melissa has also been a strong advocate for the rights of alternative lifestyle couples; she was the first attorney to obtain a court order placing two women on the birth certificate of their child, without adoption in the State of New Jersey. Melissa regularly gives lectures at prominent alternative lifestyle organizations; she has helped many alternative lifestyle couples have the baby that they have long been wishing for.
Melissa has been a keynote speaker at many prestigious institutions across the United States and is on the board of the American Fertility Association, Fertile Dreams, Conceive Magazine and Parents Via Egg Donation (PVED).
Melissa drafts and negotiates contracts for many types of reproductive arrangements including gestational carrier contracts, ovum, sperm and embryo contracts and adoption; works with international couples; finalizes same-sex and step parent adoptions; obtains court orders for gestational carrier arrangements to allow intended parents to go directly on the birth certificates of their child at birth; processes name changes; and reviews insurance books on behalf of intended parents and their gestational carriers.
